All content on www.ioamomontesarchio.it — without exception — constitutes intellectual works pursuant to Law 22 April 1941 n. 633 (Copyright Law) and subsequent amendments, as well as pursuant to Regulation (EU) 2019/790 on copyright in the digital single market. Any unauthorized use is expressly prohibited and prosecuted in competent venues.
Ownership of Rights
The exclusive economic and moral exploitation rights on all content of the site www.ioamomontesarchio.it belong to:
Pietro Luciano, creator and main author of the "Amo Montesarchio" project, based in Montesarchio (BN), Valle Caudina, Campania, Italy.
Collaborators Carmine Pavone and Francesco Tinessa are co-owners of the rights for works created by them within the project, in accordance with agreements between the parties.
Intellectual property rights extend to all content produced, commissioned or curated within the project, including those for future publication.
Protected Works
The following content on the site is protected by copyright, without need for registration or placement of © symbol:
- Video and audiovisual works: all films, short films, documentaries, reels, promotional and cultural videos, animated sequences and film productions, including those made with generative artificial intelligence techniques under the creative direction of the author.
- Photographic works: all photographs, aerial shots, video frames, images of landscapes, monuments, archaeological finds, events and people, regardless of acquisition technique.
- Literary and textual works: all texts, articles, descriptions, captions, historical transcriptions, communications, screenplays, narrative subjects, podcast texts and any written work.
- Sound works and podcasts: all audio recordings, podcasts, original soundtracks, voice narrations and audio content of any format.
- Database and content collection: the selection, arrangement and organization of materials on the site itself constitutes a database protected pursuant to Legislative Decree 196/2003 and Directive 96/9/EC.
- Visual and graphic identity: the logo, figurative trademarks, characteristic color combinations, graphic layout, templates and the overall visual identity of the "Amo Montesarchio" project.
- AI-generated content: visual, video and textual works produced with artificial intelligence tools under the direction, selection and creative curation of Pietro Luciano, as the fruit of an original intellectual process attributable to the author.
Express Prohibitions
It is expressly prohibited, without prior written authorization:
- Reproducing, duplicating, copying or printing, in whole or in part, any content of the site on any medium (digital, paper, projection or other).
- Distributing, transmitting, disseminating or making available to the public content through any channel, including social media, streaming platforms, newsletters, applications or third-party websites.
- Modifying, adapting, translating, reworking, remixing or creating derivative works based on content on the site.
- Using videos or frames as training material for artificial intelligence models, datasets, automated scraping or machine learning systems.
- Using texts, historical descriptions or educational content for academic, commercial or editorial publications without citation and without written authorization.
- Systematically extracting content from the site's database, even in partial and repeated form, pursuant to art. 102-bis of Law 633/1941.
- Removing, altering or concealing copyright indications, watermarks, metadata or any other identifying element of the author present in files.
- Using the name, logo or visual identity of the "Amo Montesarchio" project for commercial, promotional or associative purposes of third parties.
Permitted Uses
The following are permitted, within the limits provided by art. 70 Law 633/1941 (quotation for purposes of criticism, discussion, teaching and research), exclusively:
- Brief quotation of textual passages, with mandatory indication of the complete source (www.ioamomontesarchio.it) and the name of the author (Pietro Luciano), for purposes of criticism, comment or cultural review.
- Sharing direct links to site pages, without embedding (embed) of content on third-party platforms, unless specifically authorized.
- Use for non-commercial educational purposes within public school institutions, with obligation of citation and prior written communication to the authors.
Any use exceeding these limits, or of a commercial nature, obligatorily requires a written license signed by Pietro Luciano.
Authorization Request Procedure
To request authorization to use one or more contents, it is necessary to send a written communication to pietro.luciano@gmail.com containing:
- Precise identification of the content or contents for which authorization is requested (URL, title, description).
- Purpose of use, context of publication or dissemination and expected duration.
- Indication of the nature of the requester (individual, entity, company) and distribution channels.
- Any proposal of economic agreement or co-attribution.
The authors reserve the right to accept or refuse any request, at their sole discretion, and to establish economic conditions and authorized use methods.
Notice to digital platforms and search engines: pursuant to art. 15 of Directive (EU) 2019/790 (Copyright Directive), publishers of information society services intending to reproduce extracts of content published on this site must request prior authorization and agree on conditions of use with the rights holder.
Sanctions and Legal Protection
The violation of intellectual property rights described in this notice exposes the infringer to the following consequences:
- Civil liability: compensation for pecuniary and non-pecuniary damage suffered, pursuant to arts. 158 and 159 of Law 633/1941, with possibility of requesting double the proceeds derived from illicit use.
- Criminal liability: serious violations constitute a crime pursuant to arts. 171 and following of Law 633/1941, punishable with imprisonment up to four years and a fine up to € 15,493.71 in the most serious cases.
- Injunction and seizure: the rights holder may request urgently, pursuant to art. 163 Law 633/1941, the injunction of illicit conduct, seizure and destruction of unlawfully reproduced copies.
- Publication of judgment: in case of conviction, the judge may order publication of the measure at the expense of the infringer.
The authors reserve the right to take legal action, even urgently, in all cases of ascertained violation, in Italy and abroad, availing themselves of all remedies provided by current national, European and international legislation, including the Berne Convention for the Protection of Literary and Artistic Works.
Applicable Law and Competent Court
This notice is governed by Italian law. For any dispute relating to the interpretation, application or violation of the rights described on this page, the Court of Benevento is exclusively competent, unless otherwise provided by mandatory law.
For cross-border disputes, the provisions of Regulation (EU) No. 1215/2012 on jurisdiction and applicable private international law provisions apply.
Update of Notice
The authors reserve the right to update this notice at any time, to adapt it to regulatory changes or the evolution of site content. The date of last update is indicated at the top of this page. Use of the site following the publication of changes implies acceptance of the updated conditions.
